Understanding the Role of Trusts in Estate Administration

A trust is an entity in which assets are put under the control of a trustee to be used for the benefit of one or more beneficiaries. Trusts play an important role in many people's estate plans. The following are two of the most common types of estate planning trusts:

  • Revocable trusts: A revocable trust (aka living trust) is a trust that is largely controlled by the person who created it during his or her life. That person is normally the trustee until his or her death, at which point a successor trustee is appointed to take charge of the trust.
  • Contingent trusts: A contingent trust is a trust that is created by the will of someone who directed his or her assets into the trust only after his or her death. Contingent trusts are most often used to provide for the care of children who are minors or young adults.
