Will Contests

Representing Executors and Challengers in Will Disputes

If you believe that the document that has been submitted to the probate court as your loved one's will should not be treated as valid, or if you are the executor of a will that is being challenged by another party, you need skilled legal counsel from an experienced attorney.

At Kuhn Law Firm, P.A., we provide compassionate, attentive representation to parties involved in Florida will disputes. Fort Myers will contest lawyer Scott A. Kuhn has been practicing law in Florida since 2002 and personally supervises every case our firm accepts.

Understanding When the Court Can Invalidate a Will

A properly executed will is normally treated as evidence of a deceased person's wishes regarding how his or her assets will be distributed. However, there are a number of circumstances in which a probate court can invalidate a will, including the following:

  • Undue influence: The will was drafted or revised under the direction of someone who had excessive financial or personal influence, and that person would benefit from the will.
  • Fraud: The will was drafted or revised on the basis of a misrepresentation or other deception by someone who had something to gain from the new provisions of the will.
  • Incapacity: The subject of the will did not have the physical or mental capacity to make a legally valid will at the time the most recent version of the will was drafted or revised.

At Kuhn Law Firm, we recognize that will contests can be emotional and contentious proceedings during the difficult time following the death of a loved one. We will provide you with personal attention and compassionate guidance in order to achieve a fair outcome.
